Practical experience

Tammy’s experience includes assisting clients in all matters relating to Urgent Motion Court, Commercial and Civil Litigation, Administrative and Procurement Law,  Labour Law, Tax Law and Energy Law.

The following matters fall within her professional experience:

  • Advises public entities and other clients on the Constitution of the Republic of South Africa (1996), Public Finance Management Act (1999), Municipal Systems Act (2000), procurement policies and any other applicable legislation.
  • Tammy was part of a team of procurement attorneys tasked with interrogating, reviewing and drafting tender contracts, including legal oversight to ensure that tender specifications were compliant with all applicable legal and regulatory requirements, including, but not limited to the Constitution of the Republic of South Africa of 1996 (specifically in relation to procurement aspects), and the Municipal Finance Management Act 56 of 2003 as amended and the City’s Supply Chain Management Policy.
  • Tammy is also briefed to oppose review applications, both in the Labour Court and administrative review applications. The aforesaid includes advising public entities on their prospects of success in these proceedings.
  • Drafts court processes (action and application proceedings, including heads of argument), and appearances in both High and Magistrates Courts.
  • She was a part of a team of attorneys who attended to a large-scale forensic investigation into a division of the City of Johannesburg Municipality, governed by the Municipal Finance Management Act (2003) during 2020 for a period of 4 months.
  • Tammy has also been instructed by the TNPA to oversee and advise on amending its Port Guidelines, Manuals and Licenses which included public participation and effecting the necessary amendments in line with National Ports legislation.
  • She advises clients on property law and management related aspects, including advising on the Prevention of Illegal Eviction from, and Unlawful Occupation of Land Act (1998).
  • Institutes eviction proceedings on behalf of clients, including interdict applications to prevent future unlawful occupation of large properties within the Western Cape and other regions.
  • Institutes commercial eviction proceedings on behalf of clients within the Western Cape, Eastern Cape and Kwa-Zulu Natal regions.
  • Advises clients in insolvencies and participates in insolvency inquiries, including advising on the Companies Act (2008) and Insolvency Act (1936).
  • Advises SARS on tax-related matters, including interpretation of the Tax Administration Act (2011) and Value- Added Tax Act (1991).
  • She, along with a team of tax attorneys, represented SARS in the first Bitcoin Liquidation dispute in South Africa.
  • She also assists SARS to oppose tax appeals on behalf of clients in the Tax Court.
  • Tammy has attended to banking law and debt recovery for financial institutions for over 10 years and has been assisting these institutions with both secured and unsecured lending disputes, repossession of movable and immovable property, including commercial assets and liquidations.
