Practical experience

Kutloello has gained experience in general litigation & compliance. Some of the matters that she has been involved in include the following:

  • Drafting a non-disclosure settlement agreement on behalf of the National Health Laboratory Service (NHLS).
  • Assisting in a review application against the Cultural, Religious and Linguistic Rights Commission (CRL).
  • Attending to a Section 65A enquiry for the Medshield Medical Scheme.
  • Considering the Material Transfer Agreement (MTA) between NHLS and an entity, and recommending obligations in terms of the agreement to not transfer the material to any 3rd party and on whether or not the attempts by entity to register a vaccine are in breach of any provision in the MTA, including the provisions to do with benefit sharing and/or intellectual property
  • Drafting a legal opinion for Transnet highlighting facts such as instituting an urgent interdict application, review proceedings in terms of PAJA and disposal of a property procedure.
  • Provide the City of Cape Town Metropolitan Municipality with a legal opinion on the operation of a reversionary clause contained on a deed of transfer.
  • Consulting and assisting in drafting a legal opinion for the South African Revenue Service (SARS) in the interpretation of the term “bulk” in schedule 2 to the Mineral & Petroleum Resources Royalty Act, 2008.
  • Assisting the Limpopo Economic Development Agency (LEDA) (as the creditors) in Business Rescue Proceedings against the South African Post Service , whereby the creditors had to submit their claims, and advising client on the advantages and risks.
  • Assisting ADL Electrical Contractor (Pty) Ltd with a liquidation process and financial inquiries with certain individuals.
  • Attended to assist the Competition Commission (CC) with the service of instructing an independent observer to assist with the tribunal.
  • Consulting with the students of Sefako Makgatho Health Science University and conducting an investigation in the allegations of solicitation of bribes or unlawful financial gratification by students from the service provider.
  • Assisting the National Health Laboratory Service to settle a matter that would have affected its reputation had it been heard in court. Concluded by drafting the relevant non-disclosure settlement agreement.
  • Providing assistance in third party claims and drafting legal opinions, attending consultations, conducting inspection in loco and attending trial for Passenger Rail Agency of South Africa (PRASA) and Transnet Soc Ltd.
